Shawn Moore, Father Of NJ Boy Pictured With Gun, Wont Face Charges

-- No charges will be filed against a man who posted online a photo of his young son holding what appeared to be a military-style rifle, police said Wednesday.

In a moment of heightened sensitivity around guns and gun control, the brief saga had the makings of a debate starter between people who oppose guns and those who say authorities are overzealous about even legal weapons.

Police in Carneys Point, a town of 8,000 some 30 miles southwest of Philadelphia, gave their version Wednesday, days after the boy's father, Shawn Moore, brought attention to the issue, saying that state child welfare workers and police in SWAT gear showed up at his home because of the online photos.

Moore first posted a comment about the incident on a gun rights website and within days was appearing with his son, Josh, on a Fox News talk show and elsewhere. Moore said that the weapon was a .22-caliber rifle made to look like an assault rifle and that it was a gift for Josh's upcoming 11th birthday.

In a statement, Carney Point Police Chief Robert DiGregorio and Mayor Richard Gatanis said officers went to the family's home at about 8:15 p.m. Friday after getting anonymous tips that a boy there might have access to weapons and ammunition.

"In light of some of the recent school shootings across our nation, the Carneys Point Police Department takes these types of calls seriously," they said, adding that they were obligated to go there with state Department of Children and Family caseworkers who requested assistance.

Moore had said the authorities requested to see his weapons, but with his lawyer on a speakerphone he denied them access because they did not have a search warrant.

The Carneys Point officials said the officers – in night uniforms and body armor but not SWAT gear – did not attempt an unlawful search.

The officials said that they respect citizens' rights to own weapons and that several officers knew the elder Moore from a shooting club.

Moore's lawyer, Evan Nappen, said the problem is the idea that the government could respond to people talking about or with photos of weapons on social media.

"This is a shame because of the impact it has on a really good dad and his son," Nappen said. "No one was in danger."

He said the state Department of Children and Families was aggressive and intimidating and could have avoided the situation by calling first.

A department spokesman did not return calls Wednesday, but said Tuesday _without commenting on the specific case – that the department routinely checks on tips it receives.

The department has been under years of court-monitoring and has been criticized in several cases where children who died or were in peril were not checked on.

Perez Hilton Is A Father: Celeb Blogger Welcomes First Son

Perez Hilton is a dad.

The 34-year-old celebrity blogger, multimedia entrepreneur and actor shared the big news on his website. Under a photo of father and son, Perez writes: "I am ready to announce that earlier this month I was blessed with the birth of my first child, a beautiful and healthy baby boy -- with lots of hair on his tiny head!"

Saying his family was "overjoyed at this newest and most cherished addition," Perez added, "I am so humbled to welcome this little man into my life. And I am honored and ready for the challenge of guiding him through his."

Perez, who made his off-Broadway debut in "NEWSical" last fall, did not disclose any other details of the birth.

Eric Marsh, Omaha Father Who Built ‘Backyard Wonderland,' Will Go To Court

Nothing can come between a man and his land...except maybe some angry neighbors.

An Omaha father has built a truly remarkable “backyard wonderland” for his three daughters and now is fighting to protect the oasis from his neighborhood’s homeowners association.

In 2008 Eric Marsh built a miniature golf course, playground and infinity pool in his backyard after purchasing a lot adjacent to his home. But HOA board members are now trying to force him to remove his handiwork because they claim Marsh built structures that were not addressed in his original plans approved in 2006. They also say the installments are out of character for the Fire Ridge community and pose a safety hazard to neighbors.

According the World Herald, things turned nasty fast when March filed a restraining order again board member Julia Tartaglia after she allegedly wrote an email to other members saying “I say we go... hit (golf) balls all at once into his pool for no less than the time it takes to have 100 go in and clog the filter system that I am sure cost more than most vehicles.”

Though Tartaglia said it was a joke, no one’s laughing.

Marsh is going to Douglas County District Court this month to fight the HOA’s request that he fence his entire lot and remove tee boxes, AstroTurf, landscaping and the basket ball court. Marsh also wants an order stating that Targalia and the other board members can't come within 200 yards of his property.

How this will end up, no one knows. But according to KTPM, Marsh isn’t giving in anytime soon and is out to prove that the board is wrong. "As a board you don't have the right to tell me what I can and can't put in my yard. This is just them trying to make it look like I have all these exceptions when I don’t,” he told the station.

Ben And Henry Cleary FOUND: Missing Georgia Boys Located In Texas, Father George Arrested

ATLANTA -- Police said two young boys from Georgia who were reported missing this week were found safe in Texas on Saturday and their father is in custody and facing charges.

Brothers Ben and Henry Cleary – ages 9 and 7 – were visiting with their father, Daniel Cleary, of Roswell, and were supposed to return home Wednesday. An Amber Alert was issued Thursday.

Roswell Police Lt. James H. McGee said that the 46-year-old Daniel Cleary was taken into custody Saturday evening in Austin, Texas.

"We have recovered the kids," McGee told The Associated Press. "They were with him and they were OK."

Austin police said a citizen had recognized the boys from the alert and notified police at 5:11 p.m. CDT that they were at a hotel.

Officers "observed the suspect and the two boys, and recovered the two boys and took the suspect into custody," Austin police Lt. James Nisula.

The children's mother, Theresa Nash, spoke to the boys by phone and was on the way to get them.

She told FOX 5 Atlanta they were "battling each other on their IPads and planning Henry's birthday party."

Nash had told WGCL-TV in Atlanta she was concerned because Daniel Cleary had purchased a firearm about a month ago, was under stress and drinking.

Police said they did not know if Daniel Cleary was in possession of a firearm when he was taken into custody.

McGee said authorities will arrange for Daniel Cleary's extradition to Georgia. He faces a charge of interstate interference with custody, a felony. McGee said police will discuss with prosecutors whether other charges will be brought.

Police on Friday had released surveillance footage showing the two missing boys at a Walmart in Tennessee on Dec. 23 and 24 with their father. Though initial reports were that the Walmart was in Jackson, McGee said it was in fact in Chattanooga.
